Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you and FaceSeek ("FaceSeek," "we," "our," or "us") governing your use of faceseek.online and our reverse face search services, including our developer API (the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements and that your use complies with all laws that apply to you.

3. The Service

FaceSeek lets you upload a photo and find publicly available images of a similar face across the internet, returning links to the source pages. Results come from third-party websites we do not control and are provided for informational purposes only. We may add, change, or discontinue features at any time.

4. Accounts, Profile IDs, and API Keys

Some features require a profile ID or an API key. You are responsible for keeping your credentials confidential and for all activity that occurs under them. Notify us immediately of any unauthorized use. API keys are personal to your account and may not be shared or resold.

5. Acceptable Use

You agree to use the Service lawfully and ethically. You will comply with all applicable privacy, data-protection, and biometric laws, and you will only upload images you have the right to use.

6. Prohibited Uses

You may not use the Service to:

  • Stalk, harass, threaten, dox, defame, or intimidate any person
  • Conduct surveillance or identify people without a lawful basis or required consent
  • Discriminate against anyone or violate anyone's civil rights or privacy
  • Make decisions about a person's eligibility for employment, credit, housing, insurance, or similar purposes (see Section 7)
  • Break any law or regulation, including biometric-privacy laws such as the GDPR or Illinois BIPA
  • Scrape, overload, reverse engineer, or interfere with the Service, or circumvent usage limits or security
  • Resell or redistribute results or access without our written permission

7. Not a Consumer Reporting Agency

FaceSeek is not a consumer reporting agency under the U.S. Fair Credit Reporting Act (FCRA) or similar laws, and our results are not "consumer reports." You may not use the Service, in whole or in part, to make decisions about a person's eligibility for employment, credit, housing, insurance, tenancy, or any other purpose covered by the FCRA or equivalent legislation.

8. Credits, Payments, and Refunds

Some searches and API calls require credits or tokens that you purchase in advance; the Service is pay-as-you-go and does not require a subscription. Prices are shown at checkout and may change prospectively. Payments are processed by a third-party payment provider, and by purchasing you also agree to their terms. Because credits deliver digital services that are consumed immediately, purchases are generally non-refundable except where required by law or expressly stated. Results guarantee: tokens for a Premium face search are only charged when the search returns matches; if a search returns no results, no tokens are charged for it. If you believe you were charged in error, contact contact@faceseek.online. Initiating a chargeback for legitimate purchases may result in suspension.

9. Developer API

If you use the FaceSeek API, you must authenticate with your API key, stay within your purchased API Token balance and any fair-use limits, and comply with these Terms for every request. We may throttle, suspend, or revoke API access for abuse, non-payment, or violations. See the API documentation for current details.

10. Intellectual Property

The Service, including its software, models, design, and branding, is owned by FaceSeek or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain rights to the images you upload and grant us a limited license to process them solely to provide the Service.

11. Third-Party Content

Results link to content hosted by third parties. We do not own, endorse, or control that content and are not responsible for its accuracy, legality, or availability.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that results will be accurate, complete, current, or that the Service will be uninterrupted or error-free. Face-matching is probabilistic and may produce false matches or miss matches; you must not treat results as a definitive identification and should independently verify any information before relying on it.

13. Limitation of Liability

To the maximum extent permitted by law, FaceSeek and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the three months before the claim or USD 50.

14. Indemnification

You agree to defend, indemnify, and hold harmless FaceSeek from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms or of any law or third-party right.

15. Termination

We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms or harms other users, us, or third parties. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

16. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules. You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute, except where mandatory local consumer law provides otherwise.

17. Changes to These Terms

We may update these Terms from time to time. We will post the revised version here and update the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance.
